Tempers flare, nerves fray in trial against Bundy supporters (BUNKERVILLE TRIAL)

A downtown Las Vegas courtroom provided scenes as wild as a Western movie Monday when federal prosecutors and defense attorneys battled over nearly every piece of evidence presented in the trial against six of Cliven Bundy's supporters.

Defense attorneys tried to block a government witness from testifying. A prosecutor invoked an evidence rule that led even the judge to flip open a legal handbook. A juror made a wisecrack that caused one lawyer to raise concerns of potential bias.

By 4 p.m. U.S. District Judge Gloria Navarro has sent the jury home early and told them not to return until Wednesday.

The day's most hotly disputed footage was played outside the presence of the jury when defense attorney Todd Leventhal tried to bring into evidence a video from the April 2014 standoff in Bunkerville. The video was captured by a Fox News cameraman.....

The Bunkerville Standoff trial from Monday with a lot of conflict in the courtroom as lawyers argued and the jury was sent home early.

Last week a federal law enforcement witness confirmed in her testimony that on the Friday before the BLM agents raised their weapons at the protestors they received a 'stand down' order.

The jury is supposed to be back and the trial is supposed to resume today.

Why is this charade still going on when Trump supporters are being beaten bloody in California by Leftist goons who walk away free?

Sessions is a courtly joke. He could stop this crap NOW and focus on REAL threats.

LaVoy Finicum, the man killed by the “authorities”, made a
couple of videos on You Tube just a couple of weeks before
he was murdered explaining the ranchers’ position. He seemed
a sensible enough man - no wild-eyed fanatic.

This was an interesting post by Mike Arnold who was Ammon Bundy’s attorney last year at the beginning of the ordeal. The federal government is corrupt and the whole situation was politically driven, the emails from Governor Kate Brown went right up to the Whitehouse. When will we know the outcome of the FBI investigation into themselves regarding the shots fired that weren’t disclosed? When will they release LaVoy Finicum’s truck?

“The public deserved to have the video, with audio and sound, released immediately after the shooting. Now we know why it wasn’t released: the public would have heard the shots that the government didn’t want it to hear. The government should not be afraid of the public asking questions. They should encourage it. Discourse, dialogue, and criticism of the government are the bedrock of democracy.

The post-shooting FBI press conference was all to prejudice the jury, which is exactly why attorneys need to be able to speak on behalf of their clients. The answer is more speech not less. There is no prejudice of a jury when facts are released that would be heard by the jury anyway. The FBI was picking and choosing those facts. That is wrong.

Now we know why the Government is seeking a protective order trying to gag Ammon Bundy from talking about discovery.

In State v. Oliphant, this Oregon case discusses a person’s right to use physical force against a police officer in self-defense during an arrest. In Oregon, a person’s right to use force in self-defense depends on a person’s own reasonable belief in the necessity for such action, not whether the force used or about to be used on him actually was unlawful. The key here is the defendant’s reasonable belief. If a reasonable person in Finicum’s position would have believed that the use or imminent use of force against him exceeded the force reasonably necessary to affect the arrest, then he was entitled to defend himself from that use of force, i.e., by grabbing for a weapon.

The mere voicing of frustration with the government coupled with an assertion of the lawful authority to defend oneself against attack, is not a threat. But shooting at a stopped vehicle is. Finnicum wouldn’t have known that it was a less-than-lethal round. They just perceived gunshots and fled.

If the Federal Government knew that this alleged cover-up was happening, why did the FBI continue to lead the investigation? Why didn’t they bring in Deschutes County to investigate the protest site? Grant County? ATF? Anyone but the FBI who was under criminal investigation themselves.”

Defense lawyers tried to use the footage to bolster their arguments that protesters could not understand law enforcement’s instructions from 200 yards away on a windy day.

On the video, cameraman Lynch walks toward the cattle impoundment site where federal authorities were headquartered.

“I do not have a weapon — I am shooting for Fox News,” he yelled.

“You are in violation of a U.S. District Court order,” BLM Ranger Gregory Johnson’s voice boomed over the megaphone.

“I am the press!” Lynch shouted.

“Go back.”

“Why? Why can’t you talk to me?!”

“You are in violation …”

The cameraman exclaimed “We can’t hear your announcement that far away.”

U.S. District Judge Gloria Navarro would not allow the video into evidence Monday, but she told defense lawyer Todd Leventhal he could play it for jurors if he calls Lynch as a defense witness.

Local control under the Constitution allows the Berkley thing to happen for better or worse.

And that’s what the Bundy’s would like to see regarding the use of land in the West.

When the racists in the South threatened to kill the civil rights supporters, students integrating a university campus like James Meredith, there were acts of federal intervention.

The Trump Administration needs to release Dwight and Steven Hammond from their federal prison cells. Serving five year terrorism sentences for lighting a backfire to save your property is unacceptable.

That’s the place I would start.
